FMCSA PLANS INFORMATION COLLECTION REQUEST FROM MOTOR CARRIERS
The Federal Motor Carrier Safety Administration (FMCSA) has announced its plan to submit an Information Collection Request (ICR) to the Office of Management and Budget (OMB) to verify that a motor carrier of property or passengers has obtained, and has in effect, the required minimum levels of financial responsibility.
The regulations pertain to for-hire motor carriers of property to cover public liability, property damage and environmental restoration, and for-hire motor carriers of passengers to cover public liability and property damage.
The request is an extension of a currently approved information collection. Proof of the minimum levels must be kept at the carrier’s place of business, with necessary documentation available upon request by an FMCSA safety investigator during compliance reviews.
Regulations that detail the minimum financial levels are 489 CFR 387.9 for property carriers and 489 CFR 387.33 for passenger carriers.
FMCSA is asking stakeholders to comment on any aspect of the ICR, including the accuracy of any financial burden this ruling imposes and ways the burden can be minimized without reducing the quality of the collected information.
